This problem affects all browsers on all Windows 8 touch devices. The only thing necessary to reproduce is to get into a situation where the admin menu takes up most of the vertical space (for example, a smaller screen like the Surface, or if you're zoom level is larger, or if you have a lot of admin menu items), but is still fixed, and to trigger a sub-menu near the bottom of the screen with touch.
More importantly, there isn't an intuitive way to work around this issue, and new users may not even realize that they're missing menu items.
(Tested in IE 11 desktop & immersive, Chrome, and Firefox on Windows 8.1 with a Lenovo Ideapad Yoga, 1600x900 resolution).
