Currently there are checks preventing an FSE theme from being activated if Gutenberg is not installed.

Relevant changeset: [51193]

I think these need to be removed for 5.9, since Twenty Twenty-Two is a FSE theme.

Actually, I think this could just change to check for 5.9 instead of Gutenberg. Thoughts?
