Comments allowed, even though "Allow Comments" unticked

When writing a post, if "Allow Comments" is unticked and then "Publish" is chosen, the post still allows comments to be added by users. This does not apply if "Save and Continue Editing" or "Save" are chosen. In those cases, comments become disabled for the post, as it should be.

I also will add to this:

Turning off comments and trackbacks on posts will do nothing and you have nto manually turn off comments and trackbacks by re-editing.
