I have updated 2 sites from 6.5 RC4 to 6.5 and old themes going back to 2010 appear

I recommend closing this issue since the development version intentionally includes the bundled themes.

I would also recommend this for close so for now I am going to do that. Thank you for your reporting and suggestion, if you do have any further information you can always add to this ticket. Tickets can be reopened should that be something agreed open with more information.

I am not able to reproduce the issue.
Can you share more information about your installations and how you made the update?
Are you using the Beta Tester plugin?
The development version of WordPress, including WordPress 6.5, includes all previous default themes. The distributed version, for example the one downloaded from https://wordpress.org/download/, only includes the three latest themes.
